Speed Limiters on Heavy Trucks: The Rule and the Argument
Federal regulators have been trying to require speed limiting devices on heavy trucks for well over a decade, and the rule has been proposed, withdrawn, revived and revised without ever being finalized. The argument is genuinely difficult, and both sides have real evidence. What follows is what is actually being proposed and why it keeps stalling.

What Is Being Proposed
Most heavy trucks already have an electronic control unit capable of limiting road speed, and many fleets set one voluntarily. The proposal is to require that the device be set and maintained at a maximum speed for commercial vehicles above a certain weight.
The number has moved between proposals, and the current position is a matter for the Federal Motor Carrier Safety Administration rather than any summary. What has been consistent is the mechanism: use the equipment that is already fitted rather than mandate new hardware.
Rulemaking has run through multiple administrations, drawing tens of thousands of public comments, which is an unusually large response and a fair indication of how strongly the industry feels.
The Case For
Physics, mostly, and it is not a weak argument.
Stopping distance rises with the square of speed, and a loaded tractor-trailer at 80,000 pounds already needs roughly the length of a football field to stop from highway speed. Crash energy rises the same way, so the severity of any collision that does happen is substantially higher at 75 miles an hour than at 65.
Safety advocates point to reductions in fatal crash involvement where fleets limit speeds voluntarily, and to other countries where limiters are standard.
There is a fuel and emissions argument alongside it. Aerodynamic drag rises sharply with speed, so a truck limited to a lower speed burns measurably less fuel, which is a cost saving for the carrier and an emissions reduction.
The Case Against
The opposition is not simply resistance to regulation, and the central argument is worth understanding.

Speed differential. If cars travel at 75 and trucks are limited to 65, the interaction between them increases: more overtaking, more lane changes around slower trucks, and more of the situations where crashes actually happen. Drivers argue that a uniform speed is safer than a legislated gap, and there is research supporting the idea that differential speed raises risk.
Elephant racing. Two limited trucks set at fractionally different speeds take miles to complete an overtake, blocking both lanes. Anyone who drives an interstate has been behind this, and it is a direct product of limiters.
Pay and hours. Many drivers are paid by the mile. A lower speed means fewer miles in the same legal driving hours, which is a pay cut delivered by regulation, and it also means fewer loads delivered per week for small operators.
Owner-operators bear it hardest. Large fleets already limit voluntarily and would be little affected. The rule falls on the small operators who do not.
Where the Evidence Actually Sits
Both sides cite research, and the honest summary is that the absolute-speed argument is better supported than the differential-speed argument, but neither is conclusive.
Lower absolute speeds clearly reduce crash severity; that is physics rather than statistics. Whether the differential effect outweighs it depends on the size of the gap, the traffic mix and the road, and studies have reached different conclusions.
What is not seriously disputed is that the effect is smaller than either side’s rhetoric suggests. Limiters are one factor among many, and the larger determinants of truck safety are fatigue, maintenance and driver experience.
What Other Countries Do
The United States is unusual among developed economies in not requiring this, and the comparison gets cited by both sides, so it is worth stating accurately.
The European Union has required speed limiters on heavy goods vehicles for decades, set around 90 kilometers per hour, roughly 56 miles per hour. Australia limits heavy vehicles to 100 kilometers per hour. Both have had the requirement long enough that the industry is built around it.
What the comparison does not settle is the differential argument, because those countries also have lower and more uniformly enforced car speed limits. A truck limited to 56 in a country where cars run at 70 on a motorway produces a gap; a truck limited to 65 in a state where cars legally run at 80 produces a larger one.
So the international experience supports the claim that limiters are workable and does not settle whether the American speed environment makes them net positive. That distinction is frequently lost when the comparison is made.
Why It Keeps Stalling
Three reasons, and they compound.
The evidence is genuinely contested, which makes the cost-benefit analysis a rulemaking has to survive difficult to write defensibly. Administrations change and priorities move, and a rule that has not been finalized restarts more easily than one that has. And the affected industry is unusually good at mobilizing comment, because it is made up of a very large number of small operators for whom the rule is a direct and personal cost.
The practical result is a rule that has been almost final several times and is not final now. If it matters to your planning, check the current status rather than assuming either outcome.
What It Would Mean for Your Shipment
Modest and mostly predictable.

Slightly longer transit. A ten mile per hour reduction across a long run adds hours, not days, and drivers are limited by hours of service rather than by speed on most trips anyway. The practical effect is at the margin.
Possibly lower rates over time. Reduced fuel consumption is a genuine cost saving, and cost savings reach rates eventually.
No change to what you should do. Treat a delivery date as a range, book with lead time, and verify the carrier’s safety record. None of that depends on the rule.
